Cheerleader Who Refused to Cheer Her Alleged Rapist Loses Appeal


The cheerleader who was booted off her squad for refusing to chant the name of a basketball player she’d accused of rape lost her Supreme Court appeal yesterday reports the San Francisco Chronicle. The boy, a star athlete, pleaded guilty to simple assault charges following her accusation. The girl, who was sixteen at the time of the attack, was told by school administrators that she must chant the boy’s name while he was at the free throw line. When she refused, they removed her from the squad. The high court ruled that the “cheerleader was speaking for the school, not herself, and had no right to remain silent when called on to cheer the athlete by name.” The girl and her parents must pay the school $45,000 for the cost of defending the “frivolous suit.”
