Burp the Basis of Supreme Court Case

Kentucky’s Supreme Court is debating a weighty topic says the Louisville Courier-Journal: a burp. Based on the memories of his time as a prosecutor, a judge ruled that a man’s DUI charge be overturned because he burped just before a breathalyzer was administered. (Police are instructed to wait 20 minutes after a burp to administer a breathalyzer because the test is meant only to measure the amount of alcohol in a person’s lungs.) Now lawyers on both sides are before the supreme court debating whether a judge’s prior knowledge should affect what evidence is allowed into a court room.
